Introduction

Adavius takes seriously the need to protect the confidential information we gather in the course of business.   This privacy policy details how we do that.. This policy also speaks to our obligations under legislation governing "personal information" that we may have about individuals.

Different kinds of information

Like any business, we have information about clients and other individuals and corporations (e.g. suppliers.)   That information falls into three categories:

Personal information

From January 1, 2004 , all businesses engaged in commercial activities must comply with the Personal Information Protection and Electronic Documents Act, (PIPEDA.) PIPEDA gives individuals rights concerning the privacy of their personal information.   What is "personal information" under PIPEDA?

"Personal information is any factual or subjective information, recorded or not, about an identifiable individual. It includes:
•  age, name, weight, height;
•  medical records;
•  ID numbers, income, ethnic origin, or blood type;
•  opinions, evaluations, comments, social status, or disciplinary action; and, employee files, credit records, loan records, existence of a dispute between a consumer and a merchant, intentions (for example, to acquire goods or services, or change jobs.)

Personal information does not include your job title, telephone number or address, anything that might appear on your business card, or can be found through publicly available information such as the telephone book."

Confidential business information

We treat as confidential information provided us by clients about their business that is not publicly available (e.g. from a business card, website, or corporate search.)   We will not share it without your consent. Depending on the circumstances, consent may be express or implied, oral or in writing. It is also important to us to keep from spammers our clients' business contact information like email addresses.

Non-confidential information

Information that is not personal information nor confidential business information falls in this category.   It is already publicly available, so no steps are needed to protect it.

How Adavius keeps information secure

Almost all information at Adavius is stored electronically.   We use the same software that many of our clients use.   It does not segregate personal from business information.   On the contrary, as the examples below show, personal and business information are only a mouse click apart:

Adavius takes all reasonable precautions to ensure that our records of personal information and confidential business information are kept safe from loss, unauthorized access, modification or disclosure.   This includes:
•  premises security;
•  password protected access to client file access
•  deploying technological safeguards like security software and firewalls to prevent hacking or unauthorized computer access.

Dealing with SPAM

Spam is unsolicited commercial email between parties who have had no prior relationship. We don't like getting it, and don't want our clients subjected to it.   We won't sell your contact information to third parties.   Please be aware that some activities may increase the risk that your email address is "harvested" by spammers and used to send you spam.   For example:
•  Providing your contact information when Adavius reserves a domain name on your behalf. By default, Adavius only provides its own contact information to a domain name registrar, and not yours.   We hold the domain in trust for you.   If you wish to explicitly be listed as the owner of the domain name, we will do that.   However,   it increases the risk that your email address may be harvested by spammers.
•  Listing an email address on your website.   Given the purpose of a professional's website, it is almost always necessary to do this. We offer a technique for presenting an email address on an Adavius-designed website that reduces the risk it will be harvested by spammers.

Disclosure of personal Information and confidential business information

Under certain circumstances, Adavius may disclose personal information or confidential business information:
•  if we are required or authorized by law to do so, for example if a court issues a subpoena;
•  if the person is it about has consented to the disclosure;
•  if the services we are providing require us give the information to third parties, consent will be implied, unless we are informed otherwise;
•  where it is necessary to establish or collect fees;
•  if we engage a third party to provide administrative services to us and the third party is bound by our privacy policy.

Privacy rights under PIPEDA

The remainder of this policy deals with personal information that Adavius may have about you.

Why does Adavius need personal information?

As a rule, we don't. Adavius provides "business-to-business" services.   As a result most information we collect is about a business, not an individual.   However, from time to time a client may offer us personal information – for example a home telephone number. The way we manage your personal information and safeguard your privacy is subject to PIPEDA and is described in this privacy policy.

How do we collect your personal information?

We collect information only by lawful and fair means. Wherever possible we collect your personal information directly from you.

Consent

Consent to collect, use, or disclose your personal information may be in writing or oral.   It may be express or implied.   Sometimes your consent may be implied through your conduct with us.   For example, if you volunteer a home email address or a biographical detail, we assume you consent to us collecting it and referring to it in our dealings with you.   If you provide personal information about someone else (for example, that your spouse is retired) we assume that you have the authority to consent on that person's behalf to our collecting that information and referring to it in our dealings with you.

Use of your information

To the extent that we use personal information at all, it is to provide services to you,   to administer our time and billing databases and to include you in any direct marketing activities.   If you tell us that you no longer wish to receive information about our services, or about new developments in information technology for professionals, we will not send any further material.

Adavius does not disclose your personal information to any third party to enable them to market their products and services.

Updating your information

If you provide us with personal information to assist us in providing services to you, please let us know if the information changes.

Access to your personal information

You may ask for access to any personal information we hold about you.    If a request requires archive or other retrieval costs it may be subject to our normal professional and disbursement fees.

Correcting errors

If Adavius holds personal information about you and you can establish that it is not accurate, complete and up-to-date, we will take reasonable steps to correct it.

Can you be denied access to your personal information?  

Your rights to access your personal information under PIPEDA are not absolute.   For example, we may deny access when:
•  denial of access is required or authorized by law ;
•  when granting you access would have an unreasonable impact on other people's privacy;
•  to protect our company's rights and property;
•  where the request is frivolous or vexatious.
If we deny your request for access to, or refuse a request to correct information, we will explain why.

You should be aware that e-mail is not a 100% secure medium, and you should be aware of this when contacting us to send personal or confidential information.
